The terms for using Darwin and managing your subscription.
1.Your agreement with Darwin
These terms are an agreement between you and Super Signal LLC, 1309 Coffeen Avenue STE 1200, Sheridan, WY 82801, United States. If you use Darwin for a company, you must have authority to accept terms for that company. Contact ari@meetdarwin.ai with questions. These terms are effective October 20, 2026. You accept them when you agree to them during checkout or use the service.
2.What Darwin provides
Darwin provides a website assistant that answers questions from customer-supplied information, helps arrange meetings, collects requests through forms you configure, and runs experiments on chat openings. Automated setup and experiments depend on the website, connected services, available traffic, and configuration. Meeting volume, conversion improvements, and specific setup times are not guaranteed.
3.Your account and content
You are responsible for your account, authorized users, and the websites, documents, and information you provide. You must have the rights and permissions needed for Darwin to process that material and interact with visitors on your behalf. You retain your rights in your content and authorize us to process it to provide and maintain the service.
4.Using AI and connected services
AI answers can be incomplete or incorrect. Review your assistant, keep its information current, and use the test environment before installation. Do not rely on Darwin for emergency or regulated professional advice. Your selected scheduling provider controls its calendar availability and booking behavior, and its own terms also apply.
5.Plans and payment
You can start Free without a payment method. Free has no subscription fee: the first five credits are free, once per account, and each credit after that is charged at Free's per-credit price. Once the free credits are used, your assistant pauses until you add a payment method. Growth and Agency require a valid payment method at checkout and have a subscription fee and a number of credits included each month. Credits beyond the included amount are charged automatically each month at your plan's current per-credit price. A credit add-on is a monthly subscription that adds included credits and sets a lower per-credit price while it is active. Unused included credits from your plan and add-on carry over to the next monthly period only, up to one month's included amount, and are used first; carried-over credits do not carry over again. On annual billing the plan and any add-on are charged for the year in advance at ten times the monthly price; credits are still granted each month, and credits beyond the included amount are charged monthly at the per-credit price, without the annual discount. Current prices are shown on the pricing page and at checkout.
6.What uses a credit
A meeting uses one credit when the connected provider confirms a booking attributable to a Darwin conversation. A request a visitor sends through one of your outcome forms, such as a quote or callback request, uses one credit when it meets your fit rules; a request that does not meet them, and answers to the questions before a meeting from a visitor who then does not book, use no credits. Requests count three days after they are sent; until then you can remove one that was not a real request. Conversations do not use credits, and a conversation uses at most one credit across its meetings and requests. A booking or request from the same email address within 30 days of one that used at least as much is not charged again. A button click, opening a calendar, or an unverified browser notification does not count, and test chats and Agent Studio previews are excluded. Duplicate provider notifications do not create duplicate charges, a reschedule of the same meeting is treated as the same booking, and attendance does not determine whether a booking counts.
7.Changes, cancellation, and refunds
You can manage your payment method, invoices, plan, credit add-on and renewal in Settings → Billing. Upgrades, including a move from monthly to annual billing, take effect immediately: a new billing period starts with its full included credits, and the unused part of the previous fee is credited against the new charge. Adding or increasing a credit add-on takes effect immediately; its fee and its credits for the rest of the current period are prorated. On annual billing, an add-on added during the year is charged at the annual price for the months remaining, so that it renews with the plan. Downgrades, smaller add-ons, moves from annual to monthly billing and cancellations take effect at the end of the current billing period. Annual fees renew annually. A canceled meeting or no-show does not automatically reverse a credit used for a booked meeting. If you believe a charge is incorrect or want to request a refund or credit, contact ari@meetdarwin.ai with the relevant invoice and booking details. We review those requests and correct billing errors. Nothing in these terms limits refunds or other rights required by applicable law.
8.Payment failure
If a payment fails, we retry it, and your plan continues in full while we do. If it still cannot be collected, your workspace continues on Free's feature limits until payment succeeds: your assistant keeps answering visitors, and meeting booking and outcome forms are paused. Amounts already due remain payable.
9.Agency plan and client workspaces
On Agency, the paying workspace can create or link client workspaces. Included credits, add-on credits and credits beyond them are shared by the paying workspace and every linked client workspace, and all of it is billed to the paying workspace, which is responsible for usage in its client workspaces. Client workspaces have no free credits of their own. A client workspace that is detached moves to Free without free credits. Client workspaces must be detached before the paying workspace leaves Agency. We may limit the number of client workspaces to prevent abuse.
10.Plans before credits
A workspace with an Origin, Adapt, Evolve or Apex subscription keeps that plan's price, included bookings, per-booking rate, features and usage rules until its owner changes plan. Changing to Free, Growth or Agency is permanent: the earlier plan cannot be chosen again. A workspace on Origin that never added a payment method moves to Free and keeps its unused free bookings as free credits.
11.Acceptable use
Do not use Darwin for unlawful activity, deception, harassment, unauthorized collection of data, or attempts to access another customer’s workspace. Do not upload secrets or sensitive personal information that is unnecessary for your assistant. We may restrict abusive use or access that threatens the service or other users.
12.Account closure and changes
To close your account or request a data export or deletion, contact ari@meetdarwin.ai. Canceling subscription renewal in Billing is separate from deleting your workspace data. If a payment fails, the Payment failure section above applies. Updated terms will be posted on this page, and we will provide any notice required by applicable law.
